Terms of Service

1. Acceptance of Terms
By accessing or using the GeoZap Pty Ltd (ABN 41 677 686 510) website (geozap.com.au) and Cloud Services, you agree to be bound by these Terms of Service. If you do not agree, you must not use this website or our Cloud Services. Clients engaging GeoZap for consulting services will receive a formal service agreement that governs the full terms of that engagement.
2. Our Services
GeoZap provides geological and geochemical consultancy services and subscription-based Cloud Services, including XRF-ZAP and ZAP LAB. Our Cloud Services use machine learning models trained on project-specific geological data. Classification results should always be validated by a qualified geologist before use in any decision-making process. GeoZap does not guarantee specific outcomes or classification accuracy for every dataset.
3. Demo Service
Our free demo service processes a sample of your pXRF data and returns a classified PDF report. By submitting data for a demo, you confirm you have the right to share that data with us. Your data is processed on secure, isolated infrastructure and is not retained after the demo report is delivered unless you request otherwise. Demo results are indicative only.
4. Data Ownership and Confidentiality
You retain full ownership of all data you submit to GeoZap. We do not claim any ownership rights over your geological data, classifications, or reports generated from your data. GeoZap treats all Client data as confidential and will not disclose it to third parties except where required by law or with your explicit written consent. These confidentiality obligations remain in effect for 12 months from the date of any agreement.
5. Platform Improvement and Anonymised Data
GeoZap may use anonymised, aggregated, and de-identified data derived from Client usage of the Cloud Services solely to improve platform performance and refine classification models. No identifiable Client data or Confidential Information will ever be used or shared in connection with these activities. Individual Client datasets cannot be reconstructed or attributed. Clients may opt out at any time by written notice to GeoZap.
6. Sensitive Data
It is the Client’s sole responsibility to ensure that no Sensitive Data — information that must be protected from unauthorised access to safeguard the privacy or security of an individual or organisation — is submitted to GeoZap Cloud Services. GeoZap accepts no liability for any Sensitive Data loss.
7. Intellectual Property
All content on this website, including text, branding, software, ML models, classification algorithms, and platform architecture, is owned by or licensed to GeoZap. You may not reproduce, distribute, or reverse-engineer any part of our Cloud Services without prior written consent. GeoZap retains all intellectual property rights developed during any project engagement.
8. Limitation of Liability
To the maximum extent permitted by Australian law, GeoZap’s total liability is limited to fees paid for the relevant service. GeoZap is not liable for any indirect, incidental, consequential, or special loss or damage, including loss of profits, data, revenue, business opportunities, or reputation. GeoZap is not liable for any loss resulting from commercial decisions made based on our deliverables. Nothing in these terms excludes rights that cannot be excluded under Australian Consumer Law.
9. Website Availability
We do not guarantee that the website or Cloud Services will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the website or Cloud Services at any time.
10. Changes to These Terms
We may update these Terms of Service from time to time. Continued use of the website after changes are published constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Service are governed by the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
